Hearings for Albany Care’s state-initiated shutdown case could begin as soon as November, the two sides said in a virtual hearing Tuesday morning.
But those hearings may also stretch through February, as the fate of the mental health facility on Maple Avenue remains up in the air.
Illinois Department of Public Health administrative judge Evan McGinley held a brief hearing Tuesday in which attorneys for the state’s health department and Albany Care agreed to formally separate individual cases for ease in the hearing process, despite IDPH previously lobbying to formally combine all its cases against Albany Care into one.
Technically speaking, the case remains just one cumulative set of allegations made by state regulators, but will be argued in hearings separately, the sides agreed on Tuesday.
IDPH issued a Level 6 citation against Albany Care at 901 Maple Ave. in April, initiating an unprecedented license revocation process that, if successful, would shut down the facility long plagued with allegations and complaints by neighbors in the community.
